Terms of Service

These Terms of Service govern your access to and use of the Bejoss website, application, and related services provided by Yellotek, Inc.. By accessing or using Bejoss, you agree to be bound by these Terms.

If you use Bejoss on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms, and references to "you" include that entity.

If you do not agree to these Terms, do not use Bejoss.

You must provide accurate account information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You may not share access credentials in a way that compromises account security or violates your subscription or workspace permissions.

Bejoss is not intended for children, and you may use the service only if you are legally able to enter into this agreement.

Bejoss is a social media workflow tool that allows individuals and organizations to organize media, plan grids, draft and refine captions, collaborate on content, schedule posts, and publish through supported integrations.

Features may change over time, and some features may depend on subscription tier, usage limits, third-party integrations, or service availability.

We may add, remove, suspend, or modify features at any time, including AI-assisted workflows and connected publishing features.

Certain features may require a paid subscription or paid usage credits. If you purchase a subscription or credits, you agree to provide valid payment information and to pay applicable fees, taxes, and charges.

Unless otherwise stated, subscriptions may renew automatically until canceled. You are responsible for reviewing pricing, renewal terms, and any usage-based charges presented at the time of purchase.

We may change pricing, plans, feature limits, or credit structures prospectively. Continued use after a pricing change takes effect means you accept the updated pricing.

You retain ownership of the content, media, captions, notes, prompts, product information, and other materials you submit to Bejoss, subject to the rights you grant in these Terms.

You grant Bejoss a non-exclusive, worldwide license to host, store, reproduce, process, transmit, and display your content only as needed to operate, maintain, secure, and improve the service and to provide the workflows you request.

You are responsible for ensuring that you have all rights, permissions, and authority needed to upload, use, schedule, publish, and share your content through Bejoss.

Bejoss may offer AI-assisted features such as caption generation, image generation, brand voice guidance, suggestions, and related workflow tools. These features may generate results that are incomplete, inaccurate, or unsuitable for your intended use.

You are responsible for reviewing, editing, approving, and verifying AI-generated outputs before relying on them or publishing them.

You may not use Bejoss AI features in a way that violates law, infringes rights, or attempts to generate harmful, deceptive, or unauthorized content.

Bejoss may interoperate with third-party services such as Instagram, TikTok, Dropbox, Shopify, and other providers. Your use of those services remains subject to their own terms, policies, platform rules, and API requirements.

We do not control third-party services and are not responsible for outages, API changes, account restrictions, content rejections, token expiration, or other third-party actions that affect your use of Bejoss.

If a third-party provider changes or removes access, Bejoss may be unable to support some workflows or publishing capabilities.

You may not use Bejoss to violate law, infringe intellectual property or privacy rights, transmit malware, interfere with the service, bypass access controls, scrape or reverse engineer the service except where prohibited by law, or abuse shared workspaces or notifications.

You may not use Bejoss to publish or facilitate unlawful, fraudulent, deceptive, defamatory, harassing, or otherwise prohibited content.

We may investigate misuse and suspend or terminate access if we believe your use violates these Terms or creates risk for Bejoss, users, or third parties.

Bejoss and its related software, design, branding, and service materials are owned by or licensed to Yellotek, Inc. and are protected by applicable intellectual property laws.

Except for the limited right to use the service under these Terms, no rights are granted to you in Bejoss or our intellectual property.

You may stop using Bejoss at any time. We may suspend or terminate your access if you violate these Terms, if required by law, if your use creates risk or harm, or if we discontinue the service or a feature.

We may also disable or restrict access to connected integrations, workspaces, or content where reasonably necessary for security, legal compliance, or operational reasons.

Sections that by their nature should survive termination will survive, including provisions relating to ownership, payment obligations, disclaimers, limitations of liability, indemnity, and dispute-related matters.

Bejoss is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Yellotek, Inc. disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

We do not guarantee that Bejoss will always be secure, error-free, available, or compatible with every workflow, platform, or integration.

We do not guarantee that scheduled or automated publishing will always succeed, occur on time, or be accepted by third-party platforms.

To the maximum extent permitted by law, Yellotek, Inc. and its affiliates, officers, employees, agents, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, content, or business opportunities arising out of or related to your use of Bejoss.

To the maximum extent permitted by law, the total liability of Yellotek, Inc. for all claims arising out of or relating to Bejoss or these Terms will not exceed the greater of the amounts you paid to Bejoss in the twelve months before the event giving rise to the claim or one hundred U.S. dollars.

You agree to defend, indemnify, and hold harmless Yellotek, Inc. and its affiliates, officers, employees, agents, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of or related to your content, your use of Bejoss, your violation of these Terms, or your violation of any rights of another person or entity.

We may update these Terms from time to time. If we make material changes, we may provide notice through the service, the website, or by other reasonable means. The updated Terms will become effective when posted unless otherwise stated.

Your continued use of Bejoss after updated Terms take effect means you accept the revised Terms.
